Every act of violence needs to be investigated: Volker Türk on July-August events

Investigation and prosecution of every murder is a human rights demand. At the same time lynching (mob justice) is unacceptable. It is important to follow due process while filing a case. The UN High Commissioner for Human Rights, Volker Turk, said these things at a press conference after a two-day visit to Bangladesh.

On Tuesday and Wednesday, he met the chief adviser, foreign affairs adviser, law adviser, home affairs adviser and other advisers, chief justice and army chief.

In a press conference on Mob Justice, he said, ‘Every violence should be investigated, whoever did it. Mob justice of any kind is unacceptable. For this, the rule of law needs to be established.

In response to a question about cases against various people irregularly, he said, “No case can be filed without regularity.” This is very important to address. A commission has been constituted in this regard. We don’t want to repeat what was done before. There needs to be justice and a fair investigation.”

He said, “It is important that criminal cases are not filed against individuals, including Awami League members or supporters, on the basis of their previous political involvement.”

When asked about the killings that took place after August 5, he said, “Every killing, whoever is guilty, needs to be investigated – that’s very clear.” Every killing needs to be investigated and it is a human rights claim. Murder cannot be impunity.’

He said, “There is a fear that some of the allegations, including the allegations of a large number of murders against journalists, will not be established on the basis of proper investigation.” It is important not to repeat patterns of the past. I welcome the formation of a committee by the interim government to look into this matter as a tool to combat the possible proliferation of false cases. It is important to prioritize due process.

Criminal justice is important, but it is crucial to ensure that charges are not rushed and that due process and fair trial standards are maintained everywhere, including at international criminal tribunals, he said.

He said, “I found that the interim government was aware of the problems in the proceedings of the International Criminal Tribunal in the past.” My office commented on amending the ICT Act, bringing it in line with international standards and ensuring the right to fair trial and dispensation of justice without compromising due process. We will look at other ways in which we can support this process. I hope there will be a public discussion about the use of capital punishment in the future.’

Chhatra League is banned

In response to a question about declaring Chhatra League as a terrorist organization and banning it, he said, “There has been a lot of discussion about the Terrorism Act. We have seen what the results can be. “Unfortunately, in most cases, those who are dissidents or political dissidents are labeled as terrorists.”

On opening an office in Bangladesh, he said, “When a country goes through transformation, we can help them.” I wish to open office in every country, but due to financial constraints it is not possible. That’s why we prioritize where it’s needed most

প্রতিটি সহিংসতার তদন্ত হওয়া দরকার: জুলাই-আগস্টের ঘটনা নিয়ে ভলকার টুর্ক

প্রতিটি হত্যার তদন্ত ও বিচার করাই হচ্ছে মানবাধিকারের দাবি। একইসঙ্গে গণপিটুনি দিয়ে হত্যা (মব জাস্টিস) অগ্রহণযোগ্য। মামলা করার সময় যথাযথ প্রক্রিয়া অনুসরণ করা জরুরি। বাংলাদেশে দুদিনের সফর শেষে সংবাদ সম্মেলনে এসব কথা বলেছেন জাতিসংঘ মানবাধিকার বিষয়ক হাইকমিশনার ভলকার টুর্ক।

মঙ্গল ও বুধবার এই দুদিন তিনি প্রধান উপদেষ্টা, পররাষ্ট্র উপদেষ্টা, আইন উপদেষ্টা, স্বরাষ্ট্র উপদেষ্টাসহ অন্যান্য উপদেষ্টা, প্রধান বিচারপতি ও সেনাপ্রধানের সঙ্গে দেখা করেছেন।

মব জাস্টিস নিয়ে সংবাদ সম্মেলনে তিনি বলেন, ‘যেই করে থাকুক, প্রতিটি সহিংসতার তদন্ত হওয়া দরকার। যেকোনও ধরনের মব জাস্টিস অগ্রহণযোগ্য। এর জন্য আইনের শাসন প্রতিষ্ঠা করা দরকার।’

মামলা

অনিয়মতান্ত্রিকভাবে বিভিন্ন ব্যক্তির বিরুদ্ধে মামলার বিষয়ে এক প্রশ্নের জবাবে তিনি বলেন, ‘নিয়মতান্ত্রিকভাবে ছাড়া কোনও মামলা করা যায় না। এটি সুরাহা করা অত্যন্ত জরুরি। এই বিষয়ে একটি কমিশন গঠন করা হয়েছে। আগে যা করা হতো সেটির পুনরাবৃত্তি আমরা চাই না। ন্যায়বিচার প্রতিষ্ঠা এবং সুষ্ঠু তদন্ত হওয়া দরকার।’

তিনি বলেন, ‘এটি গুরুত্বপূর্ণ যে কেবল আওয়ামী লীগের সদস্য বা সমর্থকসহ তাদের পূর্ববর্তী রাজনৈতিক সম্পৃক্ততার ভিত্তিতে ব্যক্তিদের বিরুদ্ধে ফৌজদারি মামলা দায়ের করা হয় না।’

হত্যাকাণ্ড

৫ আগস্টের পরে যেসব হত্যাকাণ্ড হয়েছে সেটির বিষয়ে প্রশ্ন করা হলে তিনি বলেন, ‘দোষী যেই হোক, প্রতিটি হত্যাকাণ্ডের তদন্ত হওয়া দরকার– এটি খুব পরিষ্কার। প্রতিটি হত্যাকাণ্ডের তদন্ত হওয়া দরকার এবং এটি মানবাধিকারের দাবি। হত্যাকাণ্ডের দায়মুক্তি দেওয়া যাবে না।’

তিনি বলেন, ‘সাংবাদিকদের বিরুদ্ধে বিপুল সংখ্যক হত্যার অভিযোগসহ কিছু অভিযোগ যথাযথ তদন্তের ভিত্তিতে প্রতিষ্ঠিত না হওয়ার আশঙ্কা রয়েছে। অতীতের নিদর্শনগুলোর পুনরাবৃত্তি না করা গুরুত্বপূর্ণ। মিথ্যা মামলার সম্ভাব্য বিস্তার মোকাবিলার হাতিয়ার হিসেবে এই বিষয়টি খতিয়ে দেখার জন্য অন্তর্বর্তী সরকারের একটি কমিটি গঠনকে আমি স্বাগত জানাই। যথাযথ প্রক্রিয়াকে অগ্রাধিকার দেওয়া জরুরি।’

ফৌজদারি ন্যায়বিচার গুরুত্বপূর্ণ, তবে অভিযোগগুলো যাতে তাড়াহুড়ো করে আনা না হয় এবং আন্তর্জাতিক অপরাধ ট্রাইব্যুনালসহ সর্বত্র যথাযথ প্রক্রিয়া এবং সুষ্ঠু বিচারের মান বজায় রাখা হয় তা নিশ্চিত করা অত্যন্ত গুরুত্বপূর্ণ বলে তিনি জানান।

তিনি বলেন, ‘আমি দেখেছি যে অন্তর্বর্তী সরকার অতীতে আন্তর্জাতিক অপরাধ ট্রাইব্যুনালের কার্যধারার সমস্যাগুলো সম্পর্কে সচেতন ছিল। আমার অফিস আইসিটি আইন সংশোধন, এটিকে আন্তর্জাতিক মানের সঙ্গে সামঞ্জস্য আনতে এবং সুষ্ঠু বিচারের অধিকার নিশ্চিত করতে এবং যথাযথ প্রক্রিয়ার সঙ্গে আপস না করে ন্যায়বিচার প্রদানের বিষয়ে মন্তব্য করেছে। আমরা অন্যান্য উপায়ের দিকে নজর দেবো যাতে আমরা এই প্রক্রিয়াটিকে সমর্থন করতে পারি। আমি আশা করি ভবিষ্যতে মৃত্যুদণ্ডের ব্যবহার নিয়েও জনসমক্ষে আলোচনা হবে।’

ছাত্রলীগ নিষিদ্ধ

ছাত্রলীগকে সন্ত্রাসী সংগঠন হিসাবে ঘোষণা করে সেটিকে নিষিদ্ধ করার বিষয়ে এক প্রশ্নের জবাবে তিনি বলেন, ‘সন্ত্রাস আইন নিয়ে অনেক আলোচনা হয়েছে। এর ফলাফল কী হতে পারে, সেটি আমরা দেখেছি। দুর্ভাগ্যজনকভাবে বেশিরভাগ ক্ষেত্রে যারা ভিন্নমত পোষণকারী বা রাজনৈতিক ভিন্নমতাবলম্বী, তাদের সন্ত্রাসী হিসাবে চিহ্নিত করা হয়।’

বাংলাদেশে অফিস খোলা নিয়ে তিনি বলেন, যখন একটি দেশ রূপান্তরের মধ্য দিয়ে যায়, তখন আমরা তাদের সহায়তা দিতে পারি। আমার ইচ্ছা প্রতিটি দেশে অফিস খোলা, কিন্তু অর্থসংকটের কারণে এটি সম্ভব নয়। সেজন্য আমরা অগ্রাধিকার দেই কোথায় এটির সবচেয়ে বেশি প্রয়োজন।
